Testing & Inspection Disclaimer

All engines and transmissions sold by AutoPowerSource LLC undergo standard industry testing and inspection by qualified personnel to verify functionality at the time of sale. These tests are performed internally for quality assurance. Test data, detailed reports, or specific readings are not included with the sale and are not part of the warranty or return obligations unless expressly agreed to in writing at the time of purchase.

Warranty Limitations & Liability Disclaimer

AutoPowerSource LLC shall not be liable for any incidental, indirect, consequential, or special damages of any kind, including but not limited to inconvenience, loss of time, loss of use, loss of profits, downtime, towing charges, storage fees, rental vehicle costs, transportation expenses, or any other costs or damages arising from or related to any defect, failure, or delay under this warranty.

Mileage information provided on products is based on seller's best knowledge and available records but is not guaranteed to be exact. The sale and warranty are based on the product's present condition, its testing by qualified personnel, and the warranty coverage expressly stated herein. Any discrepancy or dispute regarding mileage shall not constitute grounds for return, replacement, refund, or warranty coverage.

Submission of fraudulent, altered, or misleading documentation for a warranty or return claim immediately voids all coverage.

Some states do not allow the exclusion or limitation of incidental or consequential damages or limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

Installation & Customer Responsibilities

• ✓ All engines, transmissions, and major components must be installed within 30 days of invoice date.
• ✓ Installation must be performed by a licensed professional mechanic. Proof of installation is required for claims.
• ✓ Customer must follow the Pre-Installation Checklist provided with the product. Failure to do so voids coverage.
• ✓ All fluids, filters, seals, and gaskets must be replaced at time of installation.
• ✓ Heat tabs must be intact and unmelted. Missing or altered heat tabs void warranty.
• ✓ Any damage caused by improper storage (rust, corrosion, rodent damage, exposure to elements) voids coverage.

Exclusions from Coverage

The following are not covered under this warranty:

• ✗ Labor, installation, removal, or diagnostic costs (unless separately purchased or pre-approved in writing).
• ✗ External accessories, including but not limited to sensors, belts, hoses, gaskets, injectors, manifolds, brackets, and oil pans.
• ✗ Normal wear and tear, seals, or leaks caused by old gaskets or seals.
• ✗ Overheating, insufficient lubrication, misuse, neglect, abuse, racing, towing, or commercial use.
• ✗ Damage from improper installation, unauthorized repairs, or modifications.
• ✗ Warranty does not cover damage caused by contaminated, dirty, or improper fluids.
• ✗ Pre-existing vehicle issues that cause damage to the purchased part.
• ✗ Consequential damages, downtime, loss of income, towing fees, rental cars, storage, or transportation expenses.

Transferability

Warranty coverage applies only to the original purchaser and is non-transferable unless explicitly authorized in writing by AutoPowerSource LLC.

Returns, Cancellations & Restocking

• ✓ Orders may be canceled within 24 hours of payment for a full refund.
• ✓ Cancellations after 24 hours are subject to a 20% restocking fee plus applicable round-trip shipping costs.
• ✓ Returns are accepted within 7 days of delivery for visible damage or warranty-covered issues, subject to inspection and approval.
• ✓ Returns outside the 7-day period are not accepted.

Governing Law, Arbitration & Jurisdiction

This agreement shall be governed exclusively by the laws of the State of Wyoming, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to the sale, warranty, or use of any product sold by AutoPowerSource LLC shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

The arbitration shall take place in Casper, Wyoming, and both parties consent to this exclusive venue. The customer and AutoPowerSource LLC agree to waive any right to participate in a class action, class arbitration, or other representative proceeding. Each party shall bear its own attorney's fees and costs, except as otherwise required by law.

If arbitration is found unenforceable for any reason, the parties agree that the exclusive venue for any court proceedings shall be the state or federal courts located in Casper, Wyoming.

Entire Agreement

These Warranty Terms & Conditions constitute the entire agreement between the Customer and AutoPowerSource LLC regarding warranty coverage and supersede all prior agreements, representations, or promises.
